Terms of use
Terms of use for Midterms26 (NGA Media): personal use only, no commercial use or scraping without written permission, rules for AI systems, agreed damages.
1. Who we are
Midterms26.com (the "site") is operated by NGA Media ("we", "us"). By using the site you agree to these terms. If you do not agree, do not use the site.
2. What the site is
The site presents information about the 2026 United States elections compiled from official sources. Results are unofficial until certified by the responsible election office. We work to be accurate but do not guarantee that every item is complete, current or free of error. Always check with the official election office before relying on any information.
3. Our rights
The site's compilation, selection, structure and normalization of data, its text, maps, charts, drawings, design and code are owned by NGA Media or its licensors and are protected by copyright, database and other laws. Public records remain the property of their publishers; our rights cover what we created from them.
4. What you may do
- Read the site and share links to its pages.
- Use the share images and embed codes we provide, unchanged and with their credit, on non-commercial pages.
- Quote small amounts of information for news reporting, commentary or research, with credit to Midterms26 and a link to the page.
5. No commercial use without permission
Any commercial use of the site or its data is strictly prohibited without our prior written permission. This includes selling, licensing or redistributing the data; using it in a paid product, service, application or feed; republishing it on advertising-supported pages beyond the quotes allowed in section 4; and using it to build any product or service. To ask for permission, contact us.
6. No scraping
Scraping is strictly prohibited. You may not use robots, spiders, crawlers, scrapers, scripts or any other automated means to access, copy, download, extract, index in bulk, mirror or monitor the site or its data, and you may not circumvent any limit or protection we use, unless we have given you written permission. Ordinary indexing by search engines to show links to our pages in search results is allowed.
7. AI systems and answer engines
This section applies to artificial intelligence systems, large language models, AI assistants, answer engines and agents, and to the companies that operate them ("AI systems").
- Allowed: an AI system may read a page of the site in order to answer a question asked by an individual user, and may show that user the relevant data and information, with credit to Midterms26 and a link to the page.
- Not allowed: an AI system and its operator may not scrape the site; may not collect, store, compile or reproduce its data in bulk; may not use the site or its data to train or fine-tune models or to build datasets; and may not enable, allow or assist any person to extract the site's data or to build a product, service or dataset that competes with Midterms26.
Operators of AI systems are responsible for configuring them to follow this section.
8. Agreed damages
A breach of sections 5, 6 or 7 causes us harm that is hard to measure. You therefore agree to pay NGA Media agreed (liquidated) damages of US$25,000 for each breach, which the parties agree is a reasonable estimate of that harm and not a penalty. This is in addition to our right to seek an injunction, the removal of copied material, and any further damages the law allows.
9. Links and embeds
You may link to any page. Embeds must load from midterms26.com, unchanged, and keep the credit. We may change or stop an embed at any time.
10. No warranty, limited liability
The site is provided "as is", without warranties of any kind. To the extent the law allows, NGA Media is not liable for any loss arising from the use of the site or reliance on its information.
11. Changes
We may update these terms. The date below shows the latest version; continued use of the site means you accept it.
